These Terms of Service ("Terms") govern your use of the Retirement Living Navigator website and the consultation, guidance, and information services ("Services") provided by Dawn Tanner trading as Retirement Living Navigator, a business operated by MI Refunds Pty Ltd ("we", "us", "our").

By accessing this website or booking a consultation, you agree to these Terms.

1. Nature of Our Services

Retirement Living Navigator provides independent guidance, education, and general information to help individuals and families better understand retirement living options and navigate decision-making with greater clarity and confidence.

We are not a retirement village operator, broker, real estate agent, financial adviser, legal practitioner, aged care assessment service, or medical provider.

Our consultations are educational and supportive in nature and are not a substitute for personalised legal, financial, medical, or aged care advice. We encourage all clients to obtain independent professional advice before signing contracts or making significant financial, legal, accommodation, or care-related decisions.

2. No Financial, Legal or Medical Advice

Information provided through our Services — including consultations, emails, written summaries, guides, checklists, or website content — is general in nature and does not take into account your personal financial circumstances, legal position, medical needs, or aged care eligibility requirements.

Nothing we provide constitutes:

  • financial product advice under the Corporations Act 2001 (Cth)
  • legal advice
  • medical advice
  • or formal aged care placement advice.

3. Bookings and Payment

Consultations are available by phone, Zoom, or in person across Melbourne, Victoria.

All fees are displayed in Australian Dollars (AUD) and payment is required at the time of booking unless otherwise agreed in writing.

Booking confirmations are sent by email once payment has been successfully received.

You are responsible for ensuring your booking details and contact information are accurate at the time of booking.

4. Cancellations and Rescheduling

Consultations may be rescheduled with a minimum of 24 hours' notice.

Cancellations made more than 48 hours prior to the scheduled consultation may be eligible for a refund at our discretion.

Cancellations made within 48 hours of the scheduled consultation, or non-attendance, are non-refundable.

We reserve the right to reschedule or cancel a consultation where necessary. If we are unable to provide a suitable alternative appointment, a full refund will be issued.

5. Client Responsibilities

You agree to:

  • provide honest and accurate information relevant to your consultation
  • use our Services for personal, non-commercial purposes only
  • not record consultations without prior written consent
  • behave respectfully during all communications and consultations.

6. Intellectual Property

All website content and materials provided through our Services — including written guides, frameworks, checklists, templates, branding, and copy — remain the intellectual property of Retirement Living Navigator and/or MI Refunds Pty Ltd unless otherwise stated.

This content may not be reproduced, distributed, modified, published, or commercially exploited without prior written permission.

7. Independent Service

Retirement Living Navigator remains fully independent and does not accept commissions, referral fees, or financial incentives from retirement villages, operators, or third-party providers.

Any references to retirement villages, operators, or external services are provided for general informational purposes only and do not constitute endorsements or recommendations.

8. Limitation of Liability

To the maximum extent permitted by law, Retirement Living Navigator and MI Refunds Pty Ltd exclude all liability for any loss, damage, cost, expense, or claim (whether direct, indirect, consequential, or otherwise) arising from or connected with:

  • your use of this website
  • your participation in consultations
  • reliance on information provided through our Services
  • decisions made based on information discussed during consultations.

Nothing in these Terms excludes rights that cannot lawfully be excluded under Australian Consumer Law.

9. Website and Third-Party Services

Our website may contain links to third-party websites or services for your convenience. We are not responsible for the content, availability, conduct, or policies of third-party websites, retirement villages, or service providers.

10. Privacy

We are committed to protecting your privacy and handling personal information responsibly.

Any personal information collected through this website or during consultations will be handled in accordance with applicable Australian privacy laws and our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. The latest version will always be published on this page with the updated revision date.

12. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any disputes arising in connection with these Terms or our Services will be subject to the exclusive jurisdiction of the courts of Victoria.
